Riyadh:With the approval of Minister of Justice Walid Al-Samaani, the Research Center at the Ministry of Justice has issued a comprehensive four-part commentary on the Civil Transactions Law. This release marks the third publication in the center's legal commentary series, following previous works on the Law of Evidence and the Personal Status Law.
According to Saudi Press Agency, the commentary is structured into four parts. The first part covers the introductory chapter and sources of obligation, the second part addresses the provisions governing obligations, the third part examines nominate contracts, and the fourth part covers real rights and final provisions.
The primary aim of the commentary is to enhance understanding and clarify the provisions of the law, thereby promoting correct application to factual circumstances. This effort is intended to support legal certainty, improve the quality of judicial decisions, and contribute specialized knowledge to the legal community.
Each article of the law is analyzed in detail, with definitions and legal terminology provided. The commentary sets out conditions for application, resulting legal effects, illustrative examples, and distinguishes cases covered by specific provisions from those that are not. It also connects the law's articles to related legislation, explains consequences of non-compliance, and identifies provisions that are public policy matters and cannot be varied by agreement.
The commentary is intended for a wide audience, including judges, lawyers, academics, researchers, legal advisers, and law students.
